India's Supreme Court has rejected an appeal to change the death penalty against a convicted rapist and murderer to life imprisonment.

Dhananjoy Chatterjee, convicted of raping and killing a schoolgirl 14 years ago, is to be hanged in Calcutta on Saturday.

His brother had appealed to the court to commute the sentence.

The case has gone through a prolonged legal process with President APJ Kalam turning down a clemency appeal.

Dhananjoy Chatterjee's lawyers had argued his conviction was based on circumstantial evidence and that DNA testing was not carried out.

'Inordinate delay'

They had further argued that 13 years on death row constituted an "inordinate delay" in his execution, creating a "mortal fear" that was punishment in itself.

The counsel for Dhananjoy Chatterjee, Colin Gonsalves, said the reason why President Kalam had rejected the mercy petition had also not been made clear.

The whole family has threatened to commit suicide if he is hanged.

Most people in the state support the death penalty in this case.

However, some human rights groups had opposed the hanging.

They had said a life sentence would have been a more appropriate punishment.

Dhananjoy Chatterjee was sentenced to death for raping and killing 16-year-old Hetal Parekh in 1990.

The death penalty is rarely carried out in India. It is usually reserved for particularly gruesome or politically sensitive cases.

The assassins of India's independence leader, Mahatma Gandhi, and former prime minister, Indira Gandhi, were among those executed in the past 50 years.

What is your opinion on death penalty? I've heard both sides and am undecided. As they say life is too precious for anyone to be killed.

I agree with the argument that 13 years of waiting for death is punishment enough, as anyone who's ever waited for his turn in engg. school practicals' vivas can testify. [:p] But yeah, in general, I'm against too much use of the death penalty. One or two exemplary cases if used judiciously can certainly deter others from committing crime. This guy's sentence was delayed 13 years. What message does it send out to would-be rapists and murderers? [:-?]

There are always people who takes one's kindness for weakness. Letting a security guard? get away for murdering & raping the very people he is supposed to protect is not logical or the right thing to do? Moreover, if death sentence is not carried out, it will be converted into life imprisonment. And liftees are eligible for parole after 10 years in prison. If mr. d is spared the death sentence, he might be out very soon. May be that is the unspoken reason APJ refused the clemency plea?

There is something called "Life Sentence without parole" or "Life Sentence with parole after 50 years" We all welcome your well structured and easy-to-read postings. [=D>]

Yes, some people act on impulse and can be forgiven with a long prison sentence, like rapists on a rush. But Planning to bomb a building or going on a shooting spree takes longer to plan, and it is not on impulse, so death for them, life sentence is a burden to the tax-payers dollars.

he's already hanged now! i don't believe in death sentence. it's so wrong! there are still many other rapists who's worse than this guy! ain't they should all be hanged too? i feel sorry for his wife!

[8D]naaa sorry ally he isnt dead till now,his hanging has be scheduled for 14/08/04,jess checked out with todays' morning news... his family think he is innocent and they are threatining to commit suicide alongside with the guilty person who is a grandfather now... well sumtimes they say justice comes late but justice is done in the end!!![#:-S] they showed the lawyers when asked their opinion stating that the man was an animal and he should be punished for what he did,he should be hanged to death...well i dunno personally coz its been such a longtime mayb if he was guilty also he might have changed over a new leaf soo now this death penalty would not be justified..at that time when he was wrong he should have been penalised!!![:-?]

This is so sensational, just take a moment to think. [img]http://img5.imgspot.com/u/04/225/21/39943042mullick.jpg[/img] In death by firing, a line of shooters fire at the prisoner, out of the many only a few has the real bullets loaded, so that no one feels guilty of killing. But this 83yr old man is responsible for hanging that man, wonder how many times he did it, sure he is a tough man, morever so because hanging is considered inhuman. And also put yourself in the mind of the prisoner, you are been walked down the plank, you know you are to be hanged. oh man...... oh man.........

The hang man told the police to provide him and his 2 sons with 2 bottles of whisky otherwise he couldnt hang the man.. hmmm... imagine living with the guilt of killing men...

Ally lots of hanging cases pending in the court.. You just dont know abt it.. Like the Dr Steines case.. I heard from my dad that his murderer is having a case going on still.. Maybe in the future u'll hear more hangings who knows....

I've been reading Telegraph's detailed version of the last few hours, I read it with a pinch of salt. Their reporting is a bit exxagerated, so I don't know about the whisky thing. But is like the calcutta's version of the movie Dead Man Walking. Chilling but nice movie.

Well i think the guilty should be killed, be it hanged, injection, electric chair, shooting or any form of killing , there is no need for keeping in prison waste of time and money ....[:)]

Every guilty man should be punished.No matter what crime he commited.Be it rich or poor, equal punishment should be given to all.
