Should a man who killed and raped a 14-year-old schoolgirl be allowed to live?
Now it is up to President Abdul Kalam to decide Dhananjoy Chatterjee's fate after the Supreme Court left the decision to the Constitutional head.
The Supreme Court decided that since a mercy plea had already been sent to President Kalam, the court should not get involved.
Dhananjoy Chatterjee, who was sentenced to death by the Calcutta High Court, will now have to wait for Rashtrapati Bhawan's response.
The President's office says the decision could take a while and will be based on a report from the Home Ministry.
Chatterjee was to be hanged early this morning. In a last minute reprieve yesterday, the Supreme Court had stayed his execution for two days.
President Kalam had also forwarded a mercy petition to the government for consideration. Subsequently, the Home Ministry asked the West Bengal government to stay his execution till a decision was taken.
Chatterjee, convicted of rape and murder of a 14-year-old girl in 1990, was sentenced to death by a sessions court in 1991, which was upheld by the Calcutta High Court and later by the apex court.
Both the President and West Bengal Governor Viren Shah had rejected his plea for mercy earlier this month.
Endless trauma
But amidst all the focus on Dhanonjoy Chatterjee, for the first time, the victim's family has given a statement.
Hetul Parikh’s family said today that they fear the possibility that the killer of their daughter would be let off.
"The family is deeply aggrieved. It was a premeditated attack. There were 21 injuries found on her body," said Indu Malhotra, lawyer for the victim Hetul Parikh.
Malhotra said the Parikh family had to flee Kolkata due to serious apprehension of a threat to their life and property.
The family moved from Kolkata to Mumbai soon after her killing and have remained firmly away from the media.
But, Dhanonjoy Chatterjee's lawyer claims that the West Bengal government deliberately dragged its feet on the case by refusing to respond to their mercy petition for ten years.
"This is not one mercy petition, the West Bengal governor rejected it without looking at the papers and the Supreme Court directed them to look at it. The petition languished in the Calcutta High Court for ten years because the West Bengal government did not file an early hearing petition for ten years," said Colin Gonsalves, Defence Counsel.
Against capital punishment
On the other side are activists who have battled the death penalty as a route to justice.
High-profile citizens like writer Mahashweta Devi and filmmakers Aparna Sen were among those who campaigned for Dhanonjoy Chatterjee's death sentence to be changed to life imprisonment.

His lawyers say the 42-year old man had already spent 14 years in prison and even if President Kalam decides to give Dhanajoy a new lease of life, the rest of his years will be spent in prison.
"Please don't teach children this hunger for blood. It will not serve anything," says Dhanonjay's lawyer Colin Gonsalves.
Both sides have presented strong, emotional arguments. It is for the President to decide but experts say that rarely has the president overturned a petition he had previously dismissed.
Vote for justice
But in Hetul's old school in Kolkata, the verdict was already in. The schoolgirls who have never met or known Hetul Parkek voted unanimously on what justice demands.
After hymns and prayers this morning at the Welland Gouldsmith School, where Hetal spent the best years of her short life, the principal asked the students for a show of hands.
Her question was, does Dhananjay Chatterjee deserve to be hanged for raping and murdering the 14-year-old. The answer was unanimous.
"Everybody, all the students, raised their hands when I asked them whether Dhananjay Chatterjee should be hanged or not," said Gillian Rosemary Hart, principal, Welland Gouldsmith School.
Three of Hetul's classmates are now teachers at Welland Gouldsmith.
Aditi Ghosh was among her best friends: either she or Hetul would always come first in class.
For her and those who knew Hetul even slightly, the debate over Dhananjoy's execution is trauma revisited.
"The human rights people who are creating the controversy are only thinking about the rights of a man who has committed a terrible crime. What about Hetul? She was an innocent victim. Didn't she have the right to live, to survive?" says Hetal's friend Aditi Ghosh.
"I think he deserves punishment for the horrible crime he committed against Hetal," says Teresa Patra, another friend of Hetal.
For the students of Hetul's school, the controversy over whether Dhananjay should be hanged or not has suddenly very complex.
They are having to relearn the definitions they had learnt for so long about right and wrong, crime and punishment, justice and mercy.
'Rarest of the rare'
Although the government keeps no records of the death penalty, the last two known executions in India were more than a decade ago.
West Bengal saw a hanging in August 1991 when Sukumar Burman and Kartik Seal were executed for murdering four members of a family.
In January 1989, Indira Gandhi's assassins Satwant Singh and Kehar Singh were put to death.
A 1983 ruling by the Supreme Court stated that the death penalty should be imposed only in "the rarest of rare cases".
The court listed various factors to be considered in determining whether a case should be considered 'rarest of rare'.
The court ruled this clause could be invoked only "when the murder is committed in an extremely brutal, grotesque, diabolical, revolting or dastardly manner so as to arouse intense and extreme indignation of the community".
Lethal injection
In April 2003, the Law Commission of India had suggested a more humane way of execution of the death penalty.

As for whether that guy should be put to death or not....it is definitely a very hard decision to make...One part of my brain says that he should spend the rest of his days rotting away in prison (we all know how Indian prisons are, it is worse than death itself ) without any chance of parole.. and the other part says that that S.O.B should be put to death asap......
For me, I think the best punishment for rapists (esp child rapists) should be to cut off their Little Johnny....[:-SS][:D]

Day 5:Chilli powder should be rubbed in the eyes.

These are the few insane things should be done to the insane people who commit these crimes,so that no one would so such crime in the near future.
As we all know the killer of Cecilia Zhang is caught now the things mentioned above should be done to that culprit.
